Credentials for Moderate Complex testing staff

I am interested in how you all might interpret CFR 493.1423 in regards to the last section a.b.4 that lists qualifications for moderately complex testing personnel as High school diploma or equivalent and meets the standards listed.  I have an MLT who performed moderatly complex testing at another facility where he was a lab aide (before his degree).  What do you all think?

According to the CLIA 2024 changes the MLT is the equivalent to an associate degree in laboratory technology which qualifies him to perform non-waived testing education wise. Training and experience are also required. the MLT can have his previous employer-see below. How long was he at the previous job and how long have they been working in the present position with you?
In my opinion he has both the education and the experience to perform moderately complex testing as an MLT. The 2024 regs go further and dig into what they call and education algorithm and he may be able to be CA too.
